Townhall Protest Tonight – Wed 20th June, 6:30pm

Tonight at 6:30pm we will be protesting outside Lambeth Town Hall (Brixton Hill, SW2 1RW – opposite Windrush Square). The local cabinet is meeting at 7pm and Lambeth Women’s Project will be joining other local groups to protest against cuts. We hope to have a strong LWP presence, to make sure cabinet members are aware of what is going on and urged to take action.

On Monday Stockwell Primary School LOCKED women into the building and were eventually made to hand over a key and open up the gates by the police. Is this how we want our schools run and local women treated?

Please come if you can – and bring a pot to bang! (if you haven’t been along to one of our protests before, check out video and photos of potbanging)

Five women  who were inside the building are also locked in. No one is allowed to enter or leave the premises. Stockwell Primary School threaten to cut off power. Brixton Blog reports witnessing one woman scale a 7ft iron fence to get out of the building.

LWP members show police the agreement that Lambeth Women’s Project have legal access to the building through the front entrance (the school only has legal access through the side entrance).

As one LWP facebook message said earlier:

Stockwell Primary School – have locked us in – no way in, no way out and have just told us they will be cutting the power!!!!!

This is unlawful!


5 women locked in LWP by school

Just received news that 5 women are currently locked in the building, as Stockwell Primary School has added a new lock to the main entrance gate. The School is threatening to cut off the power and are not allowing anyone else to enter the building.

Supporters of LWP were in the building, protecting LWP’s equipment from baillifs.

Only last week Stockwell Primary School agreed to mediation.

Will update with more information and pictures as soon as possible.

The situation so far

For an update of the history of LWP and the relationship with Stockwell Primary School, please refer to minutes from 10 June 2012. The latest updates since the last meeting are:

Legal
  • A volunteer from LWP phoned SPS who confirmed ‘nothing would happen’ until Friday 15 June
  • A local resident who has also volunteered at LWP emailed two local Herne Hill Ward counsellors (Carol Boucher and Leanne Targett-Parker) who did not respond but redirected the query to Cllr Paul McGlone (based in Ferndale Ward, former governor of SBS) who responded with incorrect information about the issue, shared personal information by copying in SBS head Janet Mulholland and Eddy Grant and instructed the resident to contact the school directly in future.
  • LWP have had a meeting with Lambeth Commissioning officer who confirmed that they did not see a role in the issue and recommend independent mediation. LWP emailed SBS on 13.6.12 to propose mediation and received a response agreeing to consider this and questioning who would be present and who would pay.
  • SPS are refusing to invoice for the outstanding ‘service charge’ money, even though they will get the money anyway if LWP are evicted
  • SPS have written to parents, advising them about changes to entry points in the building
  • SPS have made access to the building difficult, changing the key pad password on the side door as well as adding a new lock to LWP’s door without passing on new codes or keys
  • SPS and Lambeth Council have prepared two press statements about the issue. These focus on a) the ‘rent’ issue and b) lack of Charity Commission status. (Lambeth Council seemed surprised that the issue is public knowledge when a radio station rang to get the statements).
  • As a result of all these issues commissioning services is in limbo meaning that there are no wages or other support coming in from the council
  • Awareness raising has been going well – approx. 250 leaflets were given away during Tuesday’s pot banging demonstration (the 9th demo staged since the letter arrived). There’s been Facebook and Twitter activity and videos of the demonstration and of women around LWP have had a lot of viewers. Also had several pieces published online
  • LWP had a session on Resonance FM where they focussed on the impact of the loss of service on women and girls in Lambeth
Media

The rest of these minutes group the action points around three key areas: Legal, media and immediate plans. The working group will pick up Legal and media, another action group will focus on immediate plans.

Legal update

LWP are still contacting lawyers and case workers and have signed up to iprobono (an organisation that matches solicitors with cases). Urgent advice is required around:

  • Relief from forfeiture (property law)
  • Whether the SPS letter has the same legal authority as an eviction notice
  • Whether the three years remaining on the LWP lease undermines the threat of eviction
  • Advise on data protection regarding SPS moving LWP goods, particularly as goods involve personal data
  • Confirmation that under the above circumstances, that goods taken out of the building by contractors would count as an act of theft

This legal advice will help LWP prepare a response to SPS.

Action: As there is a question in what area of law the issue falls (and because of the short timescale) contact CAB or Liberty to discuss the issues ASAP (source lease to help the call). Gemma gave out contact details.

Action: Linda to help sort out old emails, including those from the old email address to start to pull together the case history

Media

Action: Working group to produce press release to be ready by Friday and to be with supportive organisations (Red Pepper, F Word etc) as soon as SPS and Lambeth press releases are issued

Action: Working group to produce a leaflet to target parents as they pick up their children, so that parents understand what is happening

NB: Whoever will be picking up media appearances will require some media training

Immediate plans

LWP have been advised by a barrister to protect their property. LWP does not hold money but their equipment is very valuable.

Friday: a group of LWP volunteers are going to be in the building all day – if you would like to join us please do. Nothing has been taken yet and the school creche is running as usual. We have taken legal advice and will update people through the day of what is happening. Thanks for your support so far.

Minutes from 10/06 Meeting

Thanks to everyone who came to the Public Meeting at LWP last Sunday and showed their support. Here’s the 10/06 Meeting Minutes [word doc], explaining more about the situation LWP are facing.

Below are some excerpts from the minutes, outlining the Plan of Action, some of the questions and responses that were raised at the meeting, and the things that LWP need right now.

Plan of Action – what happens next?

  1. LWP is looking to create a working group to deal with the issues and manage what happens next
  2. Need to secure space for storage and removal vans
  3. Have secured the support from a barrister but need a solicitor/case worker with experience of housing law (as described)
  4. Inventory of belongings required

Q&A session

LWP opened up the Q&A session with the following points:

  • Stockwell Primary School have said that if LWP have not left the building before the end of the week (either 14 or 15 June tbc) they will remove all LWP belongings and put them in storage which they will pay for a month.

–      LWP are concerned that their belongings will not be treated with respect

–      LWP are holding belongings of 11 groups that need to be notified

  • LWP explained the ‘grey area’ in legal ownership of the building and the background to the covenant agreement. They have been on site since 1979, before Stockwell Primary School. In return for the refurbishment the school and LWP entered into the covenant agreement.
  • LWP reiterated that the situation is not automatically about giving up, but that it is hard for the team to continue at the site due to the exhaustion associated with 13 years of fighting. As such, they want to work through their options which include:

–      Continue to protest, work through media, local news etc and negotiate a minimum stay of 3 months in the building to work through the issues and formulate a tenable future plan

–      Leave the building and prove their position legally through the courts retrospectively

Question: To remove people from buildings you need a court order. Is this what LWP have received?

Answer: No, LWP has received a letter, not an eviction notice. It’s not an APA but a letter on headed paper.

Question: Did the letter state who would do the eviction?

Answer: No, nor did it state the exact date when it would happen.

Question: Has LWP responded formally to the letter?

Answer: No, not yet. Want to understand legal position first.

Question: Do LWP know who in school has the problem with them?

Answer: No. The letter has come from the Board of Governors and there’s a possible conflict of interest with local councillor Paul McGlone.

Question: As member of Lambeth Save our Services, LWP will not get much help from the council. LWP will have to decide whether or not they want to fight – the school will lock LWP out and so the only way to fight is by changing the lock; the school can’t do anything then without going to court. One LWP is out of the building they will never get back in.

Answer: We agree that if we leave the building we will never get back in, and feel that Lambeth have washed their hands between us and the school.

Question: Has LWP spoken to ASS? As LWP has once had permission to stay in the building they won’t be treated legally as squatters.

Answer: No, haven’t spoken to ASS.

Question: From the wording in the school’s letter, it sounds like they’re playing hardball. These things are negotiable. Could they be approached to negotiate?

Answer: There has been a relationship breakdown and trust has been broken. We’ve had the meetings and shared the space. We need to face the fact that they’re not interested in negotiating.

Question: Have LWP contacted the press?

Answer: Yes, and they’ve been very supportive – South London Press and the Southern Weekender, and things have circulated elsewhere e.g. Twitter, blogs, websites. And the film is very powerful – we need to get that out there. We haven’t stayed silent.

Question: Have you been to the Law Centre in Lambeth?

Answer: No but we have accessed solicitors over the weekend and we’re waiting for their response.

Question: Are there specific things that LWP need?

Answer: Yes, financially LWP would need £800 to cover accounts for two years. Other than that, boxes and stuff to help the move, (possibly) two new locks, and even food for events like these. We also need to do an inventory, a paper list or database, would be helpful, as well as the pot banging demonstrations.

Question: The school needs a legal letter and a proper eviction process. Have you money for a 1hour consultation to get a response? There’s a housing lawyer in Streatham.

Answer: That’s a good idea.

We need to invite everyone along at a set time each evening. Windrush Square is useful but we need to get support within the building – the bulk of the work will need to be in the building to do an inventory and other things. Hopefully everyone (at the meeting) will be able to commit to one or the other e.g. Building or Demonstration, daytime or evening.

ACTIONS:

  • LEGAL: LWP to have 1 hour consultation with Streatham or other Housing solicitor to:

a)    Understand the legal authority of the eviction letter

b)    Understand a proper eviction process and whether Stockwell Primary School are following that process

c)    Formulate a legal response to the school

  • FINANCIAL SUPPORT: LWP to add list of financial items that require fundraising onto site (to encourage donations) including:

–      Accountancy bills

–      Legal fees

–      Food/drinks for meetings

–      Cost of locks etc

  • PHYSICAL SUPPORT: LWP to email meeting attendees asking them what they can offer over the next week, either/and any of the below:
  •  In building support: Inventories and whatever is decided as next steps to be confirmed after Tuesday’s council meeting

–      Raise awareness or offer support in any other ways

  • MEDIA: LWP to disseminate link to video through contacts and links, Tweet, blog etc [NB: Could this video be shown at the council meeting on Tuesday?]
  • NEXT STEPS: Public meeting on Wednesday 6:30pm to decide longer term actions and allocate tasks

Thanks to everyone who came to Windrush Square in Brixton last night and made some noise, and to Ed Webb-Ingall for making a video. Pots and Pans demo to continue all this week.

As LWP volunteer Nazmia Jamal says in the film:

Last week on Thursday I heard that they [LWP] had been given an eviction letter from the primary school that manages the building at the moment, and we’ve got two weeks to get out. That seems unfair. We’re protesting that fact.

As we understand it the police need 6 days notice for any march so once that is approved we can stroll from Windrush Square to Lambeth Women’s Project on Stockwell Road each night. Until then we will meet either at Windrush Square or LWP or both.

Letter calling for action to save Lambeth Women’s Project!

Dear Feminists,

Today, Lambeth Women’s Project (LWP) has been given two weeks to leave its home of more than thirty years. Stockwell Primary School (SPS) have been managing the property for little over a year and their obstructive actions have made it increasingly difficult for LWP to carry out its activities. LWP has been delivering vital services and new opportunities for young girls and women (ages 0 – 19 yrs) in the London borough of Lambeth for nearly 35 years.

After years of negotiation regarding the use of the space that LWP has been operating from, Stockwell Primary School are reneging on agreements made and are behaving unreasonably with respect to the eviction they have served on LWP.

LWP suspects that the school is motivated by the desire to retain sole use of a refurbished listed building.

The deeper issues at stake relate to the cessation of vital services being provided for young girls and women in an area of extensive poverty and deprivation, and which targets young girls and women across racial, class and disability lines.

Come and picket. Come and occupy. Come and help Lambeth Women’s Project stay where it belongs.
